CarSales Tracker Pro — Andromeda Kinship

1. Acceptance of Terms

By downloading, installing, or using CarSales Tracker Pro (the "App"), you agree to be bound by these Terms & Conditions ("Terms"). If you do not agree to these Terms, do not use the App.

2. Description of Service

CarSales Tracker Pro is a mobile application designed to help automotive sales professionals track customer deals, manage deliveries, monitor sales goals, and organize their sales workflow. The App is provided by Andromeda Kinship ("we," "our," or "us").

3. Subscription Tiers

The App offers the following subscription tiers:

Pricing & Billing: All subscriptions are billed through Apple's In-App Purchase system. Prices are in USD and may vary by region. Subscriptions auto-renew unless canceled at least 24 hours before the end of the current billing period. You may manage or cancel subscriptions through your Apple ID settings.

Deal Limits: Pro and Premium tiers are limited to 15 deals per calendar month. Advanced and Elite tiers include unlimited deals. Existing deals remain accessible regardless of subscription changes.

Free Trials: Where offered, free trials automatically convert to paid subscriptions unless canceled before the trial period ends. Each Apple ID is eligible for one free trial per subscription tier.

4. User Responsibilities

• Provide accurate information when using the App
• Use the App only for lawful purposes related to your professional sales activities
• Not attempt to reverse engineer, decompile, or disassemble the App
• Not use the App to store or transmit any unlawful, harmful, or offensive content
• Maintain the confidentiality of any customer data you enter into the App

5. Data & Privacy

• All customer and deal data is stored locally on your device.
• We do not have access to your locally stored data.
• You are solely responsible for the accuracy and security of the data you enter.
• Deleting the App permanently removes all locally stored data.

6. AI Features (Elite Tier)

• The ATLAS AI assistant is powered by OpenAI's API and requires a user-provided API key.
• AI responses are generated by third-party artificial intelligence and may not always be accurate.
• AI-generated sales scripts, advice, and recommendations are for informational purposes only and do not constitute professional or legal advice.
• We are not responsible for the accuracy, completeness, or suitability of AI-generated content.
• Your use of the AI features is also subject to OpenAI's terms of use.

7. Intellectual Property

The App, including its design, code, branding, and content, is owned by Andromeda Kinship and is protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the App for personal, professional purposes.

8. Disclaimers

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. We do not guarantee uninterrupted, error-free, or secure operation of the App. We are not responsible for any loss of data, deals, or business opportunities arising from the use of the App. Commission calculations and sales analytics are provided as tools and should be independently verified.

9. Limitation of Liability

To the maximum extent permitted by law, Andromeda Kinship shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App, including but not limited to loss of profits, data, or business opportunities.

10. Termination

We reserve the right to terminate or suspend your access to the App at any time, with or without cause. Upon termination, your right to use the App ceases immediately.

11. Changes to Terms

We may update these Terms from time to time. Continued use of the App after changes are posted constitutes acceptance of the updated Terms.

12. Governing Law

These Terms are governed by the laws of the United States. Any disputes shall be resolved in the courts of the jurisdiction in which Andromeda Kinship operates.
