These Terms of Use ("Terms") are a legal agreement between you and Andromeda Kinship LLC, a Massachusetts limited liability company, for your use of the ScrapMetal Intel mobile application ("the app"). By installing, accessing, or using the app, you agree to these Terms. If you do not agree, do not use the app.
ScrapMetal Intel is a commodity price reference tool, not a financial, investment, or trading advisory service.
The app provides spot price data for common scrap metals and educational commentary about price movements. This information is for reference only. It is not a recommendation to buy, sell, or hold any commodity, security, or asset, and it is not tailored to your personal circumstances.
Scrap metal prices vary significantly by region, grade, volume, and individual yard pricing policies. The spot prices shown reflect global commodity markets and are not what you will receive at a local yard. Always contact your local yard for their actual buying prices before making decisions.
We are not a registered investment adviser, broker-dealer, or financial institution. You are solely responsible for decisions you make based on information from the app.
We grant you a limited, non-exclusive, non-transferable, revocable license to install and use the app on iOS devices you own or control, for your personal or internal business use only. You may not reverse-engineer, decompile, extract the app's data for redistribution, or use the app for any unlawful purpose.
Certain features require a paid subscription. Subscriptions are purchased through Apple's in-app purchase system:
All subscriptions automatically renew at the end of each billing period unless you cancel at least 24 hours before the end of the period. You can manage or cancel your subscription through your Apple ID account settings (Settings → Apple ID → Subscriptions on iOS). Uninstalling the app does not cancel your subscription. Payment is charged to your Apple ID on confirmation of purchase.
All refund requests are handled by Apple per their standard refund policy. Visit reportaproblem.apple.com to request a refund. We do not issue refunds directly.
We obtain spot price data from third-party commodity data providers. We make commercially reasonable efforts to provide accurate, current data, but we do not guarantee that the data is error-free, up-to-the-minute, or suitable for any particular purpose. Network outages, data provider failures, and other issues can cause price data to become stale. The app clearly shows the last-updated timestamp — if the data appears old, treat it as stale.
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE ERROR-FREE, UNINTERRUPTED, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ANDROMEDA KINSHIP LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF THE APP. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE APP IS LIMITED TO THE AMOUNT YOU HAVE PAID US IN THE PAST TWELVE MONTHS, OR TEN U.S. DOLLARS, WHICHEVER IS GREATER.
You agree to indemnify and hold Andromeda Kinship LLC harmless from any claim or demand arising out of your misuse of the app, your violation of these Terms, or your violation of any applicable law.
These Terms are governed by the laws of the Commonwealth of Massachusetts, United States, without regard to its conflict of law provisions. Any dispute arising out of these Terms shall be resolved in the state or federal courts located in Bristol County, Massachusetts.
To the extent not inconsistent with these Terms, Apple's standard end-user license agreement applies to your use of the app, available at apple.com/legal/internet-services/itunes/dev/stdeula.
We may update these Terms from time to time. The updated Terms will be posted at this URL with a new "Last updated" date. Continued use of the app after changes are posted constitutes acceptance of the updated Terms.
